JumpTask Content Contribution Terms

Key points (a plain-language summary; the full terms below are what you agree to)

These JumpTask Content Contribution Terms (“Contribution Terms”) between Hiville, UAB (“JumpTask”, “we”, “us” or “our”) and you supplement and form part of the JumpTask User Agreement at https://jumptask.io/user-agreement/ (“User Agreement”); capitalised terms not defined here have the meaning given there. You accept the Contribution Terms when you first open a Contribution Task and re-confirm your acceptance each time you start or submit one. If you do not agree, do not take Contribution Tasks.

Contribution Tasks may be offered by JumpTask or by a third party (including a Partner), in which case Section 2 of the User Agreement applies and the third party may show you its own terms; these Contribution Terms nevertheless apply to every Submission, all rights are assigned and granted to JumpTask under Section 6, and third-party terms do not reduce these Contribution Terms. In case of conflict, the Task Instructions prevail on the technical and content requirements of a task, these Contribution Terms prevail over the User Agreement on their subject matter, and the User Agreement applies to everything else.

1.1 “Contribution Task” means any task on the Platform that asks you to create, record, upload, label, annotate, transcribe, rate or otherwise produce content or data, for example photographs, video or audio of yourself (including your face, body, movements or voice) or of your surroundings, objects, places or activities; audio recordings of your voice, speech or ambient sound; motion, sensor, depth, spatial, location or calibration data captured by your device or by a wearable, head-mounted or other recording device; written text; or labels, annotations, transcriptions, classifications or ratings applied to content provided by us or a Partner.

1.2 “Submission” means any content, data or material you create, upload, record or provide in the course of, or in connection with, a Contribution Task, in any format and at any stage (including drafts, partial uploads, retakes and Submissions that are rejected, not paid for or later removed), together with all associated metadata and any pose, keypoint, calibration, annotation or other data derived from it.

1.3 “Likeness” means your image, appearance, face, body, movements, gestures, expressions, voice, speech (including recordings of your voice) and any other visual, audio or behavioural characteristics or identifying features captured in, or derivable from, a Submission.

1.4 “Task Instructions” means the description, specifications, examples, quality criteria, earnings information and other guidance shown to you on the Platform for a particular Contribution Task.

1.5 “Partner” means any third party (including its affiliates, contractors, licensees, successors and assigns) to which JumpTask makes Submissions, Datasets or Likeness available by sale, licence, supply or otherwise, including the partners referred to in Section 1 of the User Agreement.

1.6 “Dataset” means any collection, database or corpus into which a Submission or any part of it is incorporated, in original, modified, annotated or derived form.

1.7 “AI System” means any machine-learning, artificial-intelligence, statistical or algorithmic model, system or technology of any kind (including foundation, generative, computer-vision, speech, recognition, multimodal and robotic systems), together with its weights, parameters, embeddings, fine-tuned variants, distillations and outputs.

2.1 Age. You must be at least 18 years old and have full legal capacity to take any Contribution Task, and no person under 18 may appear, be heard or otherwise be identifiable in any Submission. We may verify your age and identity before you take Contribution Tasks or before related earnings are paid out.

2.2 Local law and availability. Where the law applicable to you (including where you are located when performing a task) does not permit the creation, collection, assignment, licensing or use of a particular type of content or data as described in these Contribution Terms, we will not request it from you and the relevant Contribution Tasks will not be made available to you; you must not use a VPN, proxy or misstated location to access them. We may restrict or withdraw Contribution Tasks in any country or for any category of users at any time, and we do not guarantee that any Contribution Task will be available to you or that any Submission will be accepted.

3.1 Task Instructions. You must comply with the Task Instructions for each Contribution Task; they are incorporated into and form part of these Contribution Terms. If you cannot or will not comply with them, do not start the task.

3.2 Review. Submissions are reviewed by us, by Partners or by automated systems against the Task Instructions and these Contribution Terms. We may accept, reject or remove any Submission at our discretion and without giving reasons; if a Submission is rejected solely by automated means, you may ask for human review. Rejection does not affect the assignment and grants in Section 6, which apply from the moment a Submission is created or uploaded; whether we retain, use or delete a rejected Submission is at our discretion.

3.3 Earnings. Earnings for accepted Submissions are credited to your balance in the amount stated in the Task Instructions and are governed by Section 4 of the User Agreement; a rejected, incomplete, duplicate or non-compliant Submission earns nothing.

4.1 General requirements. Every Submission must be created by you personally, specifically for the Contribution Task, at the time and in the manner the Task Instructions require; be authentic and unaltered except as the Task Instructions permit; be accurate, complete and truthful (including any labels, annotations, self-declared attributes or answers); and comply with the Task Instructions, these Contribution Terms, the User Agreement and all applicable laws.

4.2 Prohibited content. You must not submit anything that:

(a) you did not create yourself, was created for another purpose, or was previously submitted, sold or licensed to JumpTask or to any other platform, service or person;

(b) is generated, altered or enhanced by artificial intelligence, computer-generated imagery, deepfake tools or filters, or is stock, downloaded, scraped, screen-recorded or otherwise sourced from a third party, unless the Task Instructions expressly ask for it;

(c) depicts, includes the voice of or otherwise identifies any person under 18, or any other person who has not given informed consent under Section 4.3;

(d) is sexually explicit or contains nudity; depicts violence, self-harm, cruelty or dangerous, illegal or criminal activity; was created while committing an unlawful or dangerous act (including recording while driving); or is hateful, harassing, threatening, defamatory or discriminatory;

(e) reveals special categories of personal data about you or anyone else (such as health, racial or ethnic origin, religious or philosophical beliefs, political opinions, trade-union membership, sex life or sexual orientation, or genetic data), or shows identity documents, payment cards, bank details, passwords, vehicle registration plates, home addresses, phone numbers or private messages, unless the Task Instructions expressly and lawfully request it;

(f) contains confidential information or trade secrets, material you are bound not to disclose, or material recorded in a workplace, private premises, restricted area or place where recording is prohibited, without the right to do so;

(g) prominently features third-party copyrighted works (such as music, film, television, artwork or software interfaces), trademarks or logos, other than incidentally in the background;

(h) is a duplicate or near-duplicate of another Submission, or is submitted through automation, scripts, bots, emulators or multiple accounts; or

(i) contains malicious code, is designed to manipulate, poison or degrade a Dataset or AI System, or otherwise breaches the User Agreement, these Contribution Terms, the Task Instructions or any law.

4.3 Other people. Unless the Task Instructions state otherwise, your Submissions must feature only you. If another adult appears, is heard or is identifiable in a Submission, you must first inform them how it will be used (including assignment to JumpTask, sharing with Partners and AI training) and obtain their informed consent on terms equivalent to Section 6; you are responsible for that consent and we may require a signed release. Incidental background appearances of members of the public are permitted only where lawful and allowed by the Task Instructions.

4.4 Annotation and labelling tasks. Content supplied by us or a Partner for you to label, annotate, transcribe or rate (“Task Material”) is Confidential Information under Section 6 of the User Agreement and/or confidential information of the Partner. You must use Task Material only within the Platform and only to complete the task; must not download, copy, screenshot, store, share or publish it; and must handle any personal data in it only as instructed. Task Material may occasionally contain content that some people find distressing or objectionable; you may stop a task at any time and report such content to us.

5.1 You are solely responsible for ensuring that creating and submitting each Submission is lawful where you are located, including under laws on privacy and data protection, image, publicity and personality rights, recording, intellectual property, confidentiality, trespass and property rights, and for obtaining any permission, consent, licence or permit required from any person or authority before recording. You must have the right to record at each location you use, must not record in private personal spaces such as bathrooms or changing areas and, where the Task Instructions require it, must provide a signed location or property release in the form we specify. Do not perform any activity requested by a Contribution Task that is unsafe for you or would put any person, animal or property at risk; we are not responsible for injury, loss or damage arising from how you choose to perform a Contribution Task.

6.1 Assignment of Submissions. In consideration of the opportunity to earn for Contribution Tasks, you hereby irrevocably and unconditionally assign and transfer to JumpTask, free of any third-party rights, all right, title and interest in and to each Submission (including any audio, voice, sensor or telemetry data it contains), including all copyright, related and neighbouring rights, performers’ rights, database rights, rights in data and all other intellectual property and proprietary rights, whether registered or unregistered, throughout the world, for the full term of such rights (including renewals, extensions and reversions), in all media, formats and technologies now known or later developed. The assignment takes effect automatically when each Submission is created, recorded or uploaded, without any further act, and applies whether or not the Submission is accepted, paid for, used or retained. To the extent any right cannot be assigned under applicable law, you instead grant JumpTask an exclusive (or, where exclusivity is not permitted, non-exclusive), perpetual, irrevocable, worldwide, royalty-free, transferable and sublicensable (through unlimited tiers) licence to exercise it to the same extent.

6.2 Scope. Without limiting Section 6.1, the rights assigned include the exclusive right to do, and to authorise others to do, the following with each Submission, in whole or in part, alone or combined with other content, for any purpose including commercial purposes:

(a) store, copy, reproduce and archive it;

(b) review, analyse, tag, label, annotate, transcribe, index, extract features from and enrich it;

(c) edit, crop, combine, translate, adapt, modify, transform and create derivative works, compilations and Datasets from it;

(d) use it for research, development, testing, benchmarking, evaluation, validation, quality assurance, safety testing and demonstration;

(e) use it to train, pre-train, fine-tune, align, evaluate, improve and operate AI Systems, and generate, use and exploit outputs of AI Systems, including outputs that reproduce, resemble, are derived from or are influenced by it;

(f) publish, display, perform, communicate to the public, distribute, sell, make available and otherwise commercialise it and any Dataset or derivative work;

(g) sublicense, assign, transfer, resell and otherwise make available any or all of these rights to Partners and any other person, through unlimited tiers of sublicensees, on any terms; and

(h) enforce and defend the rights in it against any person.

6.3 Likeness. Where the Task Instructions state that your Likeness (including your voice) is or may be captured, and your Likeness is captured in or derivable from a Submission, you also hereby unconditionally grant to JumpTask, to each Partner and to each further sublicensee through unlimited tiers a perpetual, irrevocable (except to the extent the law of your location grants you a non-waivable right to revoke, in which case revocation takes effect for future uses only and does not affect Submissions already delivered to Partners or AI Systems already trained), worldwide, royalty-free, fully paid-up, transferable and sublicensable right, licence, permission and consent to use, reproduce, store, analyse, adapt, modify, combine, synthesise, publish, display, perform, distribute and otherwise exploit your Likeness (including your voice and any recording of it), in whole or in part, in any medium or technology now known or later developed, for any purpose, including:

(a) incorporation into Datasets and the training, fine-tuning, evaluation and operation of AI Systems, including systems that detect, recognise, analyse, track, animate, render or generate human faces, bodies, movement, expressions, speech or voices;

(b) creating and using digital replicas, avatars, characters, voice models, synthetic voices, animations and other synthetic representations that reproduce, resemble, are derived from or are influenced by your Likeness, and generating, using and exploiting outputs of AI Systems that do so;

(c) research, development, testing, demonstration and quality assurance;

(d) incorporation into products, services, applications, media and content of any kind, and their commercial exploitation; and

(e) advertising, marketing and promotion of JumpTask, the Platform, Partners and their respective products, services and AI Systems.

Any description of intended use in the Task Instructions is for information only and does not limit this Section 6.3. This Section 6.3 applies equally to the likeness of any other person who appears, is heard or is identifiable in a Submission, for whom you must have obtained the consents described in Section 4.3.

6.4 Likeness restrictions and release. JumpTask will not, and will contractually require Partners not to, knowingly use your Likeness (a) in pornographic or sexually explicit content, (b) in content that is defamatory of you, or (c) to depict you as personally endorsing a political party, candidate or cause; these restrictions do not apply to unintended or incidental resemblance, to generic characteristics shared with other people, or to outputs generated by third-party users of AI Systems, which JumpTask does not control. Otherwise you have no right to inspect, approve or object to any permitted use of your Likeness and, to the fullest extent permitted by law, you release JumpTask, Partners and sublicensees from any claim based on rights of publicity, personality, privacy, image, voice or name, or any similar right, arising from permitted use. AI Systems trained on your Likeness may generate outputs that resemble you and, although we do not attach your name or account details to Submissions provided to Partners, we cannot guarantee that you will not be identifiable.

6.5 Moral rights. To the fullest extent permitted by law, you waive and agree not to assert any moral rights in any Submission against JumpTask, Partners or sublicensees, and you consent to each Submission being modified, combined, synthesised and used anonymously and without attribution.

6.6 No retained rights. JumpTask owns each Submission exclusively. You may keep a personal copy for private, non-commercial reference only and must not publish, share, sell, license, submit elsewhere or otherwise exploit any Submission.

6.7 Consideration. The earnings stated in the Task Instructions for an accepted Submission are the full and final consideration for the assignment and grants in this Section 6; you are not entitled to any royalty, revenue share or other payment, regardless of the extent or value of any use or who makes it. For Submissions that are not accepted, the opportunity to participate in Contribution Tasks is sufficient consideration.

6.8 Datasets and AI Systems; no recall. You acknowledge and agree that:

(a) all Datasets, AI Systems, outputs, derivatives and other results created using or derived from any Submission are owned exclusively by JumpTask, its Partners or their licensees, and you have no right, title, interest, claim or licence in any of them;

(b) we have no obligation to use, retain, publish, keep confidential, return or deliver to any Partner any Submission, and may delete or discard Submissions at any time;

(c) once a Submission has been delivered to a Partner, incorporated into a Dataset or used to train an AI System, it cannot be recalled, and an AI System cannot be made to “unlearn” it; and

(d) accordingly, neither JumpTask nor any Partner has any obligation to recall, withdraw, delete or modify any Submission, Dataset or AI System, or to retrain, roll back, alter or restrict any AI System, including after closure of your account, termination of the User Agreement or these Contribution Terms, or a request by you, except where, under applicable data protection law, your interests or fundamental rights override our legal or contractual obligations and legitimate interests, in which case we will delete the Submission from our own systems and notify any Partner that still holds it; AI Systems already trained on a Submission cannot be reversed.

6.9 Further assurance. At our request you will sign any document reasonably required to confirm or register the rights assigned or granted under this Section 6 and, notwithstanding the “Our Relationship, Taxes and Permits” provision of the User Agreement, you authorise JumpTask to sign such documents on your behalf if you do not.

7.1 Relationship with the Privacy Policy. Our Privacy Policy (https://jumptask.io/privacy-policy/) applies to all personal data we process about you, including your rights, security and international transfers. This Section 7 describes the additional processing specific to Contribution Tasks and prevails over the Privacy Policy on that subject matter. 7.2 Data we collect. Depending on the task: (a) Submission content, including your Likeness and voice, your surroundings, anything shown or heard, and any motion, sensor, depth, spatial, location or calibration data captured with it; (b) self-declared attributes the Task Instructions ask for, such as age range, gender, country or region, native language, accent, height or dominant hand; (c) technical and task metadata, such as task identifiers, timestamps, review status and quality scores, device type and model, operating system and app version, camera and recording settings, file properties and embedded file metadata, and approximate location (country or region) derived from your IP address or, where a task specifically requests it and you allow it, device location; (d) a pseudonymous contributor identifier assigned by us; (e) age- and identity-verification data where we verify you under Section 2.1; and (f) records of your acceptance of these Contribution Terms and of any task-specific consent (timestamp, version accepted and pseudonymous identifier). We do not request, and do not knowingly collect, special categories of personal data (such as data on health, racial or ethnic origin, religious or political beliefs, sexual orientation, or biometric data used to uniquely identify a person); Submissions containing your Likeness are processed to develop and train AI Systems, not to uniquely identify you, and you must not include such data in a Submission (Section 4.2(e)).

7.3 Purposes and legal bases. We process this data to operate Contribution Tasks (making tasks available, receiving and reviewing Submissions, crediting earnings, compiling Datasets, delivering Submissions and Datasets to Partners, and developing, training, testing and operating AI Systems), which is the performance of our contract with you; to ensure quality, prevent fraud and abuse, secure the Platform and protect our rights, to promote JumpTask, the Platform and Partners which are our legitimate interests; and to comply with our legal obligations. We do not rely on your consent for this processing, except where consent is mandatory under the law applicable to you, and the assignment and grants in Section 6 do not depend on consent. Where consent is mandatory, we will ask for it before you start the relevant Contribution Task, and the task will not be offered to you without it (Section 2.2). You may withdraw such consent at any time; withdrawal takes effect for future processing by JumpTask only and does not affect processing already carried out, Submissions already delivered to Partners or AI Systems already trained, subject to Section 6.8(d).

7.4 Sharing with Partners. We share, sell and license Submissions, Datasets and the data in Section 7.2(a) to (d) to Partners, which may be located anywhere in the world and may further share them with their affiliates, licensees and customers or, where the Task Instructions so indicate, make Datasets publicly available. Partners receive Submissions under your pseudonymous identifier only; we do not give them your name, email address, login or payout details unless required by law or with your specific agreement. Each Partner is an independent controller responsible for its own processing. Where a Partner requires evidence that the Submissions it receives were lawfully obtained, we may provide it with the acceptance records described in Section 7.2(f) and confirmation of whether your identity has been verified, under your pseudonymous identifier; we disclose your name or identity documents only where the law requires or with your specific agreement.

7.5 AI training and retention. The principal purpose of Contribution Tasks is to create data for developing, training, fine-tuning, testing and operating AI Systems, by JumpTask and by Partners. AI Systems trained on your Submissions may retain information derived from them indefinitely in their weights and parameters and may generate outputs that resemble or reproduce elements of your Submissions or Likeness; that processing cannot be reversed, and Section 6.8 applies. We may retain Submissions and associated data for as long as they form part of a Dataset or are needed for the purposes in Section 7.3, including after you close your account, and thereafter as required by law or for legal claims.

Each time you start or submit a Contribution Task, you represent and warrant to JumpTask (and, for the purposes of Section 6, to each Partner and sublicensee) that:

(a) you are at least 18 and have full legal capacity to agree to these Contribution Terms and to make the assignment and grants in Section 6, and you are not bound by any employment, agency, exclusivity, union or other agreement that restricts you from doing so;

(b) each Submission is your own original creation, made personally by you for the Contribution Task, and you are its sole author and owner and have not assigned, licensed or encumbered any right in it to anyone other than JumpTask, and each Submission is provided exclusively to JumpTask;

(c) your Submissions, and their use as permitted by these Contribution Terms, do not and will not infringe any intellectual property, privacy, data-protection, publicity, personality, image, contractual or other right of any person or any law, and creating and submitting them is lawful where you are located;

(d) you have obtained all consents, releases, permissions and licences required under Sections 4.3 and 5 and will provide evidence of them on request;

(e) all information, labels, annotations, self-declared attributes and answers you provide are accurate, complete and given in good faith, and no Submission is AI-generated, synthetic, altered, stock, scraped or otherwise sourced from a third party unless the Task Instructions expressly ask for it; and

(f) you take part in Contribution Tasks as an independent contributor; you are not an employee, worker or agent of JumpTask or of any Partner, and you will not assert any employment, labour or similar claim against any Partner in connection with a Contribution Task.

To the extent permitted by applicable law, you will indemnify, defend and hold harmless JumpTask, its affiliates, officers, employees and agents, and its Partners and their sublicensees, from and against all claims, losses, damages, liabilities, fines, costs and expenses (including reasonable legal fees) arising out of or in connection with (a) any breach of your representations, warranties or obligations under these Contribution Terms, (b) any Submission, including any claim that it or its permitted use infringes the rights of any person, or (c) your violation of any law in connection with a Contribution Task. This Section does not limit any other right or remedy of JumpTask, and does not require you to indemnify us for losses caused by our own breach of these Contribution Terms, fraud or wilful misconduct.

10.1 Breach. If we reasonably believe you have breached these Contribution Terms, we may, in addition to the remedies in the User Agreement, reject or remove any Submission, withhold, reverse or offset earnings, remove your access to Contribution Tasks and notify affected Partners. Because Submissions are supplied to Partners and used in AI Systems, a breach may cause harm that damages cannot adequately remedy and, notwithstanding the negotiation step in Section 10 of the User Agreement, JumpTask and Partners may seek injunctive or other equitable relief for any actual or threatened breach.

10.2 Changes. We may amend these Contribution Terms in the manner set out in the User Agreement, and you will be asked to accept the amended Contribution Terms the next time you take a Contribution Task after the change takes effect. Amendments apply to Submissions made after they take effect and do not reduce the assignment and grants made in respect of earlier Submissions.

10.3 Survival. Sections 4.4 and 6 to 10 survive termination of these Contribution Terms and the User Agreement, closure of your account and your ceasing to use the Platform, without limit in time.
